ShipUp is committed to fair, transparent, and non-deceptive digital marketing practices as aligned under Section 1031 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (UDAAP provisions).
1. What is UDAAP?
UDAAP stands for Unfair, Deceptive, or Abusive Acts or Practices. These standards are enforced to protect consumers from misleading corporate activities, ensuring that all advertising, promotional transparency, and consumer interactions are clear and honest.
2. Unfair Practices — Prohibited
An act is considered "unfair" if it causes substantial injury to consumers that is not reasonably avoidable. ShipUp strictly prohibits:
- Marketing strategies or targeting algorithms that exploit consumer vulnerabilities
- Promoting client landing interfaces with hidden fees or undisclosed recurring charges
- Bait-and-switch tactics or misleading advertising layouts for complex financial tools
- Deploying predatory creative templates targeted toward financially distressed demographics
3. Deceptive Practices — Prohibited
A practice is "deceptive" if it misleads or is highly likely to mislead a consumer acting reasonably under the circumstances. All active campaign creatives must:
- Accurately represent the client's verifiable products or technical services
- Clearly disclose all material terms, transactional costs, and mandatory eligibility conditions
- Not omit structural information that would heavily influence a consumer's decision-making process
- Ensure testimonials and reviews reflect typical, verified consumer experiences
- Avoid confusing, complex, or contradictory legalese concerning service rates or fees
4. Abusive Practices — Prohibited
Abusive acts materially interfere with a consumer’s ability to understand a term or condition. We prohibit:
- High-pressure tactics or coercive language in performance ad funnel architectures
- Conditioning digital user access on the waiver of standard consumer protections
- Excessive frequency capping or automated communication harassment across advertising distribution networks
- Misrepresenting core contractual terms during lead generation or registration pathways
5. Client & Creative Vetting Process
Before launching or managing any external brand campaign, ShipUp conducts standard internal quality checks:
- Comprehensive auditing of destination pages for clear, UDAAP-compliant footnotes and opt-out disclosures
- Verification that pricing indices, processing rates, and basic terms are prominently readable
- General assessment of customer satisfaction and corporate reputational metrics for the client brand
- Confirmation of mandatory localized legal disclosures for financial and professional business verticals
6. Standard Disclosures for Specialized Verticals
- Transparent financial metrics and clear APR range disclosures where required by law
- Transparent repayment schedules, service durations, and programmatic termination milestones
- Honest presentation of complete system costs or evaluation variables
- Clear and visible identification of the legal operating entity providing the product
- Easy access to licensing information and consumer compliance resources
