ShipUp strictly adheres to the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and all related FCC regulations governing telephone, cellular, and SMS marketing communications.
1. What is the TCPA?
The Telephone Consumer Protection Act (TCPA) is a federal law designed to restrict unsolicited telephone solicitations and the automated use of telephonic equipment. It strictly covers marketing calls, interactive voice responses, and automated text messages to mobile phones.
2. Our TCPA Compliance Commitment
- Obtain prior express written consent before initiating any automated, autodialed, or pre-recorded calls or marketing texts
- Honor all user Do-Not-Call (DNC) or opt-out requests within 10 business days
- Maintain a secure internal Do-Not-Call registry and cross-scrub marketing lists against the National DNC Registry
- Provide direct, clear identification of the brand and transmitting party in all outbound communications
- Restrict communication delivery windows strictly to 8 AM – 9 PM in the consumer's local time zone
- Include standard automated opt-out mechanisms (e.g., STOP keywords) in all text-based marketing campaigns
3. Consent Requirements
3.1 Prior Express Written Consent
For strategic outreach and text campaigns utilizing automated systems or programmatically generated delivery channels, we ensure:
- A clear, conspicuous disclosure stating that the user will receive automated marketing messages or system alerts
- The user's definitive affirmative agreement, which is never framed as a mandatory condition of service or purchase
- Transparent identification of ShipUp and the specific campaign partner for whom the user is granting consent
3.2 Consent Documentation
All compliance records and user consent actions are systematically maintained with cryptographically secure timestamps, verified IP addresses, and a copy of the exact consent disclosures presented.
4. Client & Advertiser Requirements
- Confirm that all marketing lists or customer records provided to us possess explicit, fully valid TCPA consent
- Provide verifiable documentation of acquisition channels, consent language, and subscriber source methodologies
- Formally accept and sign our dedicated TCPA Compliance Addendum as part of the client service agreement
- Indemnify ShipUp against any legal actions or regulatory penalties stemming from client-supplied non-compliant databases
5. Do-Not-Call Policy
ShipUp maintains a corporate internal Do-Not-Call repository and cleanses programmatic call lists against national registries, state-specific restriction lists, and our own suppression databases.

6. Violations and Remediation
Any suspected compliance friction or formal TCPA inquiries are reviewed by our internal compliance team within 5 business days. Validated procedural exceptions trigger immediate campaign suspension and comprehensive operational remediation pathways.
